Rights of Persons with Disabilities

Under the Canadian Charter of Rights and Freedoms, Canadians with disabilities have rights in common with all other Canadians including not to be discriminated against. Such rights become important in many cases ranging from the balancing of rights of people with disabilities and their support workers in private homes to the rights of a student with a disability as it relates to support in the regular classroom. Derek W. Hillier, Q.C., Fiona Innes and Mary (Waterman) Newton have done considerable work in this area including a detailed review of the law related to alternatives to Guardianship for people with severe disabilities.
